Warranty Conditions

Regulatory References The goods supplied by Pandhora srl - Benefit Society are guaranteed under the terms and in the manner provided by Legislative Decree 206/05 and ss.ii. against manufacturing defects, material used, conformity for a duration of 24 months from the date of delivery to the consumer, excluding custom-made devices to which the provisions of DM 332/99 and DPCM 12/01/2017 all.5 apply. The commencement of the warranty is documented by the delivery note. The warranty is expressly limited to free repair or replacement of parts recognized as defective. The warranty applies on condition that the purchaser documents that he/she has complied with what is stated in the user manual and that the necessary periodic maintenance has been carried out punctually and correctly.
Scope of Application The warranty covers material and manufacturing defects present at the time of delivery. The defect must be reported within 2 months of discovery, under penalty of forfeiture of the right (Art. 132 Legislative Decree 206/2005).

Only the authorized distributor/reseller may assert warranty rights against Pandhora srl - Benefit Society, so the customer is not given the power to assert them (these warranty conditions are therefore for information only).

Warranty Terms Pandhora S.r.l. - Benefit Company guarantees:
- Pursuant to Article 132 of the Consumer Code, the product is covered by a legal warranty of conformity for 24 months from the date of delivery, exclusively for the final consumer (B2C).
- Rigid and structural components from material and manufacturing defects for a period of 24 months from the date of delivery.
- Pursuant to art.130 paragraph 4 and in derogation of art. 133 paragraph 1, Legislative Decree 206/2005 appropriate information is given that some devices have a warranty of less than 24 months, such as batteries , battery chargers and electrical components, whose warranty is limited to 12 months from the date of delivery.
The battery is considered consumable material; any replacement batteries will have coverage equal to the remaining duration of the original warranty, up to a maximum of 12 months from the first delivery of the product. Parts subject to normal wear and tear are not covered by warranty, except abnormal wear and tear due to manufacturing defect.

Warranty Conditions The warranty is valid only if:

- The product is used properly and according to the directions in the user manual.
- No unauthorized modifications have been made.
- No serial numbers or identification labels have been removed or altered.
The warranty is immediately void in the following cases:
- Failures resulting from accidents, shocks, falls, improper use or lack of maintenance.
- Repairs, disassembly or modifications performed by unauthorized workshops or with non-original components.
- Failures resulting from inadequate storage conditions or causes not attributable to the manufacturer.
- Removal or tampering with the nameplate bearing the serial number of the product.
- Modification of the speed, different from the UNI EN 12184/2022 legal limit of 20 Km/h results in immediate forfeiture of the warranty.
Replacement of a part or any warranty work does not extend the life of the original warranty.

Warranty Exclusions Pursuant to Article 130 of the Consumer Code, the warranty does not apply in the case of:
- Damage resulting from misuse, accidents, falls, impacts, or neglect.
- Modification, repair or disassembly by unauthorized workshops or with non-original parts.
- Causes not the fault of the seller/manufacturer.
Warranty does not cover:
- Routine maintenance, adjustments, programming, and periodic checks.
- Batteries beyond the 12-month specific warranty period.
- Additional costs (e.g., for repair, packaging, personnel time charges, etc.)..)
- Parts subject to normal wear and tear, such as (indicative list):
- Tires, inner tubes, wheel rings, single-body wheels
- Padded parts, upholstery
- Handles, knobs
- Fuses, light bulbs, electric motor charcoal, brake pads

Methods of Intervention During the warranty period:
- The customer should contact the nearest authorized dealer or contact Pandhora S.r.l. -Benefit Company
- Interventions will be carried out at an authorized center or by shipment at the customer's expense (unless otherwise agreed).
- If the fault falls under the warranty, the repair or replacement will be free of charge.
- If the defect does not exist or does not fall under the warranty, the costs will be borne by the customer.
Interventions are carried out during ordinary working hours (excluding vacations, vacations and force majeure). Visits for simple adjustments or maintenance requested by the customer are chargeable.

Limitations and Responsibilities
- Warranty does not cover transportation, shipping and labor costs unless acknowledged defect.
- The guarantee is personal and non-transferable.
Pandhora S.r.l. - Benefit Society shall not be liable for:
- Damage resulting from negligence, neglect of use, tampering, improper installation
(reference "Warranty Activation" section) or maintenance by unauthorized personnel.
- Transportation, shipping or labor costs, unless otherwise agreed.
Excluded from the warranty are:
- Damages due to transportation, not directly communicated to the shipper at the time of delivery.
- Repairs carried out by unauthorized centers and personnel.
- Damages produced to property or persons during the use of our products.
- The damages caused by the malice or fault of the purchaser, or by an incorrect and improper use of the means.
- The damages caused to the means, to things and to persons resulting from the use of any device, accessory or object mounted/added to the wheelchair without the written authorization from Pandhora S.r.l. - Benefit Society
Excluded from the guarantee are any claims for indemnity except those punctually mentioned in the preceding paragraphs of this chapter.

Warranty Activation
Warranty activation must be done by following the instructions in the Basic Info document, included in each EP3 product package.
